Welcome to regmount.com. These Terms & Conditions (“Terms”) form a binding agreement between you and RegMount (“RegMount,” “we,” “us,” or “our”) and govern your access to and use of our website at regmount.com (the “Site”) and your purchase of RegMount products, including the RegMount regulator-mounted camera adapter, accessory packs, replacement parts and related items (the “Products”).
Please read these Terms carefully. They include an assumption of risk for diving activities, disclaimers of warranties, a limitation of liability, an indemnity, and provisions on governing law, venue and dispute resolution (sections 10, 18, 19, 20, 21 and 22). By using the Site or buying a Product, you agree to these Terms. If you do not agree, do not use the Site or buy our Products.
1. Acceptance of these Terms
By accessing the Site, creating an account, placing an order or submitting any content, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, Shipping Policy, Refund & Returns Policy, Warranty and Disclaimer, each of which is incorporated into these Terms by reference. If there is a conflict between these Terms and a specific policy, the specific policy controls for its subject matter.
If you use the Site or buy Products on behalf of a business (for example, a dive shop), you represent that you have authority to bind that business to these Terms, and “you” includes that business. Authorized dealers may also be subject to a separate dealer agreement, which will control in the event of a conflict.
2. Eligibility
You must be at least 18 years old (or the age of majority in your place of residence, if higher) and able to form a legally binding contract to create an account or buy Products. If you are under 18, a parent or legal guardian must place the order, accept these Terms on your behalf and supervise your use of the Products.
Our Products are designed for use by divers who hold an appropriate scuba certification from a recognized training agency and who dive within the limits of their training and experience. Owning a RegMount does not qualify anyone to dive, and it is not a substitute for training.
3. Products and product descriptions
We try to describe and photograph our Products as accurately as possible, including compatibility information such as the regulator second-stage body diameter range of 2 3/8″ to 3 1/8″ (60 to 80 mm). However:
- Colors and finishes may look slightly different on your screen than in person.
- Regulator designs vary, and manufacturers change their products. Our fit guide and fit checker are provided to help you decide, but they are guidance only. It is your responsibility to confirm that a Product fits your specific regulator and camera before diving with it.
- Camera compatibility refers to cameras that use the standard GoPro-style mounting interface. Results may vary with camera housings, accessories and third-party mounts.
- We may improve, change or discontinue Products, packaging or kit contents at any time without notice. Any material change to a Product you have already ordered will be communicated before shipment where practical.
Product descriptions, installation guides, videos, blog articles and other content are provided for general information. They do not replace the instructions and warnings for your regulator, camera or other dive equipment, nor professional dive training.
4. Pricing and availability
- All prices are listed in US dollars (USD) and do not include applicable sales tax, which is calculated at checkout based on your shipping address where required by law.
- Free U.S. shipping applies only to the Products and destinations stated on the Product page or in our Shipping Policy. International shipping charges, duties, import taxes and customs fees, where applicable, are the buyer’s responsibility.
- Prices, promotions and availability can change at any time without notice. The price that applies to your order is the price shown at the time you place it.
- Products are offered while supplies last. If an item becomes unavailable after you order, we will contact you to offer a substitute, a delay or a full refund for that item.
- We make every effort to avoid errors, but if a Product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may refuse or cancel orders placed for that Product, even after you receive an order confirmation. If your payment has already been taken, we will refund it in full.
5. Orders and order acceptance
Placing an order is an offer by you to buy the Products in your cart at the stated prices and on these Terms. The order confirmation email you receive after checkout confirms that we received your order; it does not mean we have accepted it. A contract is formed when we ship the Products and send you a shipping confirmation.
We may refuse or cancel any order, or limit quantities, for reasons including:
- the Product is unavailable or a pricing or description error occurred;
- we cannot verify your payment or billing information;
- the order appears fraudulent, unauthorized or placed by a reseller in violation of our dealer policies;
- we cannot ship to the requested destination; or
- the order would violate applicable law or export restrictions.
If we cancel an order after you have paid, we will issue a full refund to your original payment method.
Changes and cancellations by you. We are a small team and often ship quickly. If you need to change or cancel an order, contact us as soon as possible at [email protected] or (850) 356-6770. If the order has not shipped, we will do our best to accommodate you. Once an order has shipped, our Refund & Returns Policy applies.
6. Payment
We accept the payment methods shown at checkout. Payments are processed by third-party payment processors, and we do not store your full card number. By submitting payment information, you:
- represent that you are authorized to use the payment method;
- authorize us and our payment processors to charge the full amount of your order, including taxes and any shipping charges; and
- agree to provide accurate and complete billing information.
If a payment is declined or reversed, we may cancel or suspend your order. If you believe a charge is wrong, please contact us first. We will usually resolve the issue faster than a card dispute or chargeback can.
7. Promotional codes and offers
- Promotional codes, discounts and special offers are valid only for the period and on the terms stated, and may be limited to specific Products, quantities or customers.
- Unless stated otherwise, only one code may be used per order, and codes cannot be combined with other offers, applied to past orders, exchanged for cash or transferred.
- Codes have no cash value and may not be sold or published on coupon websites without our permission.
- We may change or cancel any promotion at any time and may cancel orders that use codes obtained or applied fraudulently or in violation of the offer terms.
- If you return a Product bought with a discount, the refund is limited to the amount actually paid.
8. Shipping and delivery
Shipping methods, processing times, delivery estimates and international shipping details are described in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Carriers such as USPS, UPS and FedEx may experience delays outside our control, especially during peak seasons and severe weather.
Title to and risk of loss for Products pass to you when we deliver them to the carrier, except where applicable consumer law provides otherwise. If your package is lost, damaged in transit or shows as delivered but did not arrive, contact us promptly and we will work with you and the carrier to make it right.
Traveling soon? If you need your RegMount before a dive trip, add your departure date in the order notes or call us. We will tell you honestly whether standard shipping is likely to make it.
9. Returns, refunds and warranty
Returns, exchanges and refunds are governed by our Refund & Returns Policy. Warranty coverage, exclusions and the claims process are described on our Warranty page. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.
10. Product use, diving safety and assumption of risk
Scuba diving, freediving and spearfishing are inherently dangerous activities that carry a risk of serious injury, decompression illness, drowning and death. Adding any accessory to your life support equipment, including a camera on your regulator second stage, changes how your gear feels, handles and behaves, and adds to your task loading.
Official RegMount safety disclaimer: It is the responsibility of the user/scuba diver to familiarize themselves with the RegMount prior to use. NSS-CDS standards require a minimum of 100 dives in an overhead environment prior to using any additional equipment due to task loading. Assembly of the RegMount on personal equipment is the sole responsibility of the user. RegMount is not responsible for damaged or lost equipment during use and/or installation. Please dive safely.
By buying or using a RegMount Product, you acknowledge and agree that:
- You are responsible for training and judgment. You will dive only within the limits of your certification, training, experience and physical condition, and you will follow the safe diving practices taught by your training agency, including proper buoyancy control, gas planning and buddy procedures.
- You will familiarize yourself with the Product first. Before diving, you will read the installation guidance on our How It Works page, assemble and test the Product on your own equipment, and practice in a controlled environment, such as a pool or confined water, before using it in open water.
- Installation is your responsibility. You are solely responsible for correctly assembling and attaching the Product to your regulator and camera, confirming fit, tightening the clamp appropriately (the clamp uses a metric nut), and inspecting the Product and your regulator before every dive.
- You will preserve regulator function. You will confirm that the mounted Product does not interfere with breathing, the exhaust, the purge button, the mouthpiece or your ability to share air, and that you can still deploy your alternate air source and perform all standard skills. If anything feels wrong, you will not dive with it.
- Overhead environments require extra experience. You will not use additional equipment such as a camera in caves, caverns, wrecks or other overhead environments unless you have the specific training and experience required, consistent with the NSS-CDS guidance above.
- Diving comes first. You will never let filming distract you from monitoring your depth, time, gas supply, buddy and surroundings, and you will abandon filming immediately if it compromises safety.
- Camera and equipment risk is yours. RegMount is not responsible for damaged or lost cameras, lights, regulators or other equipment during installation or use. We strongly recommend using a tether, such as our camera safety tether, and checking all connections before each dive.
- You voluntarily assume the risks. To the fullest extent permitted by law, you knowingly and voluntarily assume all risks of injury, illness, death, property damage or loss arising from diving, spearfishing or any water activity in which you use the Products.
Our Products are not life-support equipment, are not intended to be used as or in place of any part of your breathing system, and must not be used for any purpose that could restrict your airway or the function of your regulator. Do not modify the Products. Alternative uses described on our Site, such as mounting the Product on an octopus or using it to hold a light, are suggestions only and must be practiced and evaluated by you for your own diving. 11. User accounts
You may create an account to check out faster and view your order history. You agree to:
- provide accurate, current and complete information and keep it up to date;
- keep your password confidential and not share your account;
- notify us immediately of any unauthorized use of your account; and
- accept responsibility for all activity under your account, except activity resulting from our own negligence.
We may suspend or close accounts that violate these Terms, appear fraudulent, or have been inactive for an extended period. You may close your account at any time by contacting us. Order records may be retained as described in our Privacy Policy.
12. Reviews, comments and user content
The Site may allow you to post product reviews, ratings, comments, photos, videos and other content (“User Content”). You are solely responsible for your User Content and represent that:
- you own it or have all rights needed to post it and grant the license below;
- it is truthful and reflects your genuine experience with the Product;
- it does not infringe anyone’s intellectual property, privacy or publicity rights; and
- it complies with these Terms and applicable law, and anyone identifiable in a photo or video has consented to its use.
12.1 License you grant us
By submitting User Content, you grant RegMount a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, reproduce, display, publish, adapt, edit for length or clarity, translate, distribute and create derivative works from your User Content, in any media, for the purpose of operating, promoting and improving our business, including on the Site, in marketing materials and on social media. We will credit you by the display name you provided where practical. If you send us diving footage directly, we will ask for your permission before featuring it, and any separate written agreement we make with you will control.
12.2 Moderation
We do not endorse User Content and are not obligated to publish or keep it. We may review, edit for formatting, decline or remove any User Content at our discretion, including content that is spam, off-topic, abusive or misleading, or that violates these Terms. We do not remove or suppress reviews simply because they are negative, consistent with the Federal Trade Commission’s rules on consumer reviews.
12.3 Incentivized reviews
If we ever give you something of value in exchange for a review, such as a discount or free product, you must clearly disclose that in your review. We will never require that a review be positive.
13. Prohibited uses
You agree not to:
- use the Site for any unlawful, fraudulent or harmful purpose, or in violation of these Terms;
- place fraudulent orders, use stolen payment methods or abuse promotions, returns or warranty claims;
- post User Content that is false, defamatory, obscene, hateful, harassing, threatening, infringing or that contains personal information of others without consent;
- impersonate any person or business, or misrepresent your affiliation with RegMount (for example, by claiming to be an authorized dealer when you are not);
- attempt to gain unauthorized access to the Site, other accounts, our servers or networks, or bypass security measures, including our firewall;
- introduce viruses, malware or other harmful code, or interfere with the Site’s operation through denial-of-service attacks, excessive requests or similar means;
- use bots, scrapers, crawlers or other automated tools to access, copy or monitor the Site, except for search engine indexing in accordance with our robots.txt file;
- copy, reverse engineer or reproduce our Products, designs or Site content for commercial purposes;
- resell Products in a way that misleads buyers about their origin, condition or warranty; or
- use the Site to send unsolicited commercial messages.
We may investigate violations and take any action we consider appropriate, including canceling orders, closing accounts, blocking access and reporting conduct to law enforcement.
14. Intellectual property
The Site and all of its content, including text, graphics, logos, product designs, photographs, videos, guides, illustrations, software and the selection and arrangement of that content, are owned by or licensed to RegMount and are protected by United States and international copyright, trademark and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use, such as browsing and buying Products. You may print or share links to individual pages for personal reference. You may not otherwise copy, reproduce, modify, distribute, publicly display or create derivative works from Site content without our prior written permission.
14.1 Trademarks
RegMount and the RegMount logo are trademarks of RegMount. You may not use them in connection with any product or service that is not ours, in any manner likely to cause confusion, or in any way that disparages us, without our prior written permission. Authorized dealers may use our marks only as permitted in their dealer agreement.
GoPro is a trademark of GoPro, Inc. RegMount is not affiliated with, sponsored by or endorsed by GoPro, Inc. References to GoPro and other camera brands are made only to describe compatibility. All other trademarks mentioned on the Site belong to their respective owners.
14.2 Feedback
If you send us ideas, suggestions or feedback about our Products or Site (for example, a new way to use your RegMount), you agree that we may use them freely without any obligation to you.
15. Copyright complaints (DMCA)
We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please follow the procedure in our DMCA Policy. We may remove content and terminate the accounts of repeat infringers.
16. Third-party links and services
The Site may contain links to, or embedded content from, third-party websites and services, such as training agencies, safety resources, shipping carriers, payment processors and video platforms. YouTube videos on our Site load only after you click to play. We do not control and are not responsible for third-party content, products, services or privacy practices, and a link does not imply our endorsement. Your use of third-party services is at your own risk and subject to their terms.
17. Site availability and changes
We may change, suspend or discontinue any part of the Site at any time without notice. We do not guarantee that the Site will be available at all times or free from errors, and we are not liable if the Site is unavailable for any period. We may also correct errors, inaccuracies or omissions in Site content, including Product information and prices.
18. Disclaimers of warranties
Except for the express limited warranty described on our Warranty page, and to the fullest extent permitted by applicable law:
- THE SITE, ITS CONTENT AND THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.
- REGMOUNT DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
- WE DO NOT WARRANT THAT ANY PRODUCT WILL FIT EVERY REGULATOR OR CAMERA, THAT IT WILL PREVENT LOSS OF OR DAMAGE TO ANY CAMERA OR EQUIPMENT, OR THAT IT WILL PRODUCE ANY PARTICULAR FOOTAGE RESULT.
- WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE OR CURRENT.
- INFORMATIONAL CONTENT ON THE SITE, INCLUDING ARTICLES ABOUT DIVING TECHNIQUE, CAMERA SETTINGS, TRAVEL AND SAFETY, IS GENERAL INFORMATION ONLY AND IS NOT PROFESSIONAL DIVE INSTRUCTION, MEDICAL ADVICE OR LEGAL ADVICE.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In that case, any implied warranties are limited to the shortest duration permitted by law.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT WILL REGMOUNT, ITS OWNERS, EMPLOYEES, AGENTS, DEALERS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, FOOTAGE, GOODWILL OR USE, OR FOR THE COST OF SUBSTITUTE GOODS, ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- REGMOUNT IS NOT LIABLE FOR ANY LOSS OF OR DAMAGE TO CAMERAS, LIGHTS, REGULATORS OR OTHER EQUIPMENT DURING INSTALLATION OR USE OF THE PRODUCTS.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE PRODUCTS OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US $100).
These limitations apply even if a limited remedy fails of its essential purpose. They do not limit liability that cannot be limited under applicable law, such as liability for death or personal injury caused by our gross negligence or willful misconduct, or for fraud. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
20. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless RegMount and its owners, employees, agents, dealers and suppliers from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use or misuse of the Products, including improper installation, modification or use beyond your training;
- your diving, spearfishing or other water activities;
- your User Content;
- your violation of these Terms or of any law or third-party right; or
- any person’s use of the Products you supplied to them.
We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with our defense.
21. Governing law and venue
These Terms and any dispute arising out of or relating to them, the Site or the Products are governed by the laws of the State of Florida, USA, and applicable federal law of the United States, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to section 22, you and RegMount agree that any lawsuit must be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction and venue of those courts. If you are a consumer residing in the EU or UK, you may also be entitled to bring proceedings in the courts of your country of residence and to the protection of mandatory consumer laws of that country.
22. Dispute resolution
Talk to us first
Most problems can be solved quickly. Before starting any formal proceeding, you agree to contact us at [email protected] with the subject line “Dispute,” including your name, contact details, order number (if any), a description of the issue and the outcome you want.
Good-faith negotiation
We will try in good faith to resolve the dispute informally. If it is not resolved within 60 days after we receive your notice, either party may start formal proceedings. We agree to follow the same process before bringing a claim against you.
Courts of Florida
If informal resolution fails, the dispute will be resolved in the state or federal courts located in the State of Florida, as described in section 21.
Small claims carve-out. Notwithstanding the above, either party may bring an individual claim in a small claims court of competent jurisdiction, including in the county where you reside, as long as the claim qualifies and remains in small claims court.
Time limit. To the extent permitted by law, any claim arising out of or relating to these Terms, the Site or the Products must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
Individual claims. To the extent permitted by law, disputes will be resolved on an individual basis, and neither party will bring claims as a plaintiff or class member in any purported class or representative proceeding.
Injunctive relief. Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court to protect intellectual property rights or prevent irreparable harm.
23. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permissible, or severed if necessary, and the remaining provisions will remain in full force and effect.
24. Entire agreement, waiver and assignment
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and RegMount regarding the Site and the Products and supersede any prior agreements or communications on those subjects. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a sale of our business.
25. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including hurricanes, tropical storms and other severe weather, natural disasters, carrier disruptions, supply shortages, pandemics, government actions, power or internet outages and labor disputes.
26. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page and, for material changes, provide reasonable notice on the Site. Changes apply to orders placed and use of the Site after the updated Terms are posted. The Terms in effect at the time you place an order govern that order. Your continued use of the Site after changes take effect means you accept the updated Terms.
27. Electronic communications
By using the Site or contacting us electronically, you consent to receive communications from us electronically, including by email and through notices on the Site. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing.
